What can unregistered assistants do?

The Real Estate and Business Brokers Act states that a person must be registered under the Act in order to trade in real estate.

The Real Estate and Business Brokers Act states that a person must be registered under the Act in order to trade in real estate. Unregistered assistants cannot undertake any activity that falls into the category of “trade.”

Some of the activities that are prohibited include being on site at an open house, door knocking in a “farming” area, phone solicitation, showing properties, or being a participant at an offer or listing presentation.

The Registrar’s Bulletin (September 16, 1999 available on www.reco.on.ca ) states, “for any activity that does NOT fall under the definition of “trade,” an assistant may be paid by the sales representative or associate broker providing all laws and regulations regarding employee-employer relationships are complied with.”

Some sales representatives and associate brokers have been able to broaden the scope of responsibilities for their administrative assistants by hiring people who are “licensed” or registered under the Act. The Registrar’s Bulletin also outlines how registered or licensed assistants can be paid. “For any activity that falls under the definition of “trade,” any assistant must be registered under the act to the same brokerage as the sales representative or associate broker and can only be paid by the broker (brokerage) to whom he/she is registered for undertaking such activity.”
