Keep proof of payment of Do Not Call List

Marketing, specifically telemarketing, gets a little tougher by the end of this month when the National Do Not Call List (DCNL) will be up and running on September 30, 2008.

Marketing, specifically telemarketing, gets a little tougher by the end of this month when the National Do Not Call List (DCNL) will be up and running on September 30, 2008. Consumers can register their telephone numbers (up to three different numbers) on the National DNCL on that date. For many Canadian consumers, the National DNCL will come as a relief to the nuisance of telemarketing calls.
 
We’ve covered this in the June and July/August issues of the REALTOR® EDGE but it bears repeating that the law bans a telemarketer from making a telemarketing call unless the telemarketer is a registered subscriber of the National DNCL and has paid all applicable fees to the National DNCL operator. A telemarketer must keep proof of its subscription to the National DNCL and proof of payment of fees to the operator for a period of three years from the date the records are created. Telemarketers can subscribe to the National DNCL at www.LNNTE-DNCL.gc.ca or call 1-866-580-DNCL (3625).
 
Calls do not have to stop immediately. As telemarketers you will have 31 days to update your calling lists. If consumers continue to receive non-exempt calls 31 days after they have registered they will be able to file complaints with the National DNCL operator. So, REALTORS® must be ready to comply by October 31.

To help REALTORS® understand their obligations for compliance CREA established a DNCL Compliance Centre at www.realtorlink.ca. The CREA booklet “The National Do Not Call List” can be found at CREA’s DNCL Compliance Centre.
 
Ontario REALTORS® can take the OREA Continuing Education Course “The Do Not Call Registry” to learn about the National DNCL; contact your local board to register for this classroom-only course.
 
The Canadian Radio-television and Telecommunications Commission (CRTC) has established a National DNCL resource centre at http://www.crtc.gc.ca/eng/dncl.htm where telemarketers can find information to help them understand their obligations for compliance with the National DNCL. The CRTC has also published some common questions and answers about the National DNCL in various pamphlets available in its resource centre.
